Nepal’s Social Media Bill: Regulation or Restriction? The government has tabled a bill on social media regulation in the National Assembly, on 28 January 0205. The bill proposes economic fines and imprisonment for both social media platforms and users under various provisions. Individuals operating social media platforms in Nepal without permission or violating a ban could face fines of up to Rs 2.5 million. Actions deemed harmful to national interests could result in up to five years of imprisonment, a Rs 500,000 fine, or both. The bill also criminalizes cyberbullying (two years in prison or a Rs 300,000 fine), cyberstalking (three years or Rs 500,000), and hacking, phishing, extortion, and sextortion (three years or Rs 1.5 million). Posting grotesque content, spreading false information, or using pseudonymous identities could also lead to fines or imprisonment. Repeat offenders face double penalties, and public officials could receive up to 50% additional punishment. Despite the rise of social media, Nepal lacks specific regulatory laws, there has been need to regulate this but this bill has sparked widespread criticism. The Federation of Nepali Journalists (FNJ) argues it curtails freedom of expression and was drafted without stakeholder consultations. Political leaders like Gagan Thapa and Bishow Prakash Sharma acknowledge the need for regulation but fear the bill threatens democratic norms and free speech. Rastriya Swatantra Party released a press notice calling for the withdrawal of the bill and a complete rewrite to ensure the fundamental rights of citizens, as the currently proposed bill poses a serious threat to them. Experts believe that the bill’s provisions, taken together, pose a systemic threat to freedom of expression and association in Nepal. Digital Rights Nepal (DRN) strongly opposes the proposed Social Media Bill, viewing it as a direct assault on fundamental rights, particularly freedom of expression and privacy. The bill’s vague and overly broad provisions create significant risks of misuse, allowing authorities to arbitrarily silence dissenting voices, suppress critical speech, and intimidate users. Instead of fostering a rights-respecting regulatory framework, the bill grants sweeping powers to the state, enabling censorship and disproportionate penalties that could stifle democratic discourse. DRN urges the government to engage in meaningful consultations with stakeholders including civil society, journalists, and digital rights experts to ensure that any regulation upholds constitutional freedoms, aligns with international human rights standards, and safeguards an open and democratic digital space in Nepal. | | | NCSC Issues 102-Point Advisory to Strengthen Government Cybersecurity National Cyber Security Centre has issued a comprehensive 102-point advisory to enhance the security of government websites, data, and networks. The advisory outlines crucial measures to safeguard digital infrastructure, improve cybersecurity awareness, and address vulnerabilities. Centre Director Raj Kumar Maharjan emphasized that negligence and lack of awareness are major contributors to cyber risks, stating that the advisory is not just for government employees but for all citizens to help reduce cyber threats. The guidelines include security tips on website, application, and server security; storage and network security for government offices; desktop, laptop, and printer security; password management; internet browsing safety; email and phishing attack prevention; removable media security; social media safety; and mobile security. The Centre has called for the proactive adoption of these measures to mitigate cyber threats and protect the nation’s digital infrastructure. Ministry Seeks Feedback on Environmental and Social Commitment Plan for Digital Nepal Project The Ministry of Communications and Information Technology has released the draft Environmental and Social Commitment Plan (ESCP) for public consultation ahead of the Digital Nepal Project Agreement. The ESCP is a key component of the financial agreement between the Government of Nepal and the World Bank. The Ministry has invited stakeholders to review the draft and provide their feedback before finalizing the agreement. Nepal’s Digital Address System ‘Kataho’ Wins World Summit Award Nepal’s digital address system Kataho has won the World Summit Award (WSA) in the Smart Settlements and Urbanization category. Developed by Ram Laxman’s team through Addressgraph Nepal Pvt. Ltd., Kataho enables offline address searches and allows sharing address codes within three seconds using a unique combination of words and digits. Over 10,000 people have already used the system to create digital address boards. WSA recognizes innovative technologies that contribute to the UN Sustainable Development Goals (SDGs). The award ceremony will take place in Hyderabad, India, from April 6-9, 2025. Pakistan Criminalizes Online Disinformation Amid Press Freedom Concerns Pakistan has passed a new law criminalizing online disinformation, imposing prison sentences of up to three years for those who intentionally spread false information that may cause fear or unrest. The legislation, rushed through without consultation, was approved by the National Assembly on January 28, 2025, prompting journalists to stage a walkout in protest. Media groups condemned the move stating government of betrayal after earlier assurances of consultation. Critics argue the law is a tool to suppress dissent, particularly amid ongoing crackdowns on former Prime Minister Imran Khan’s supporters. Setopati’s YouTube Channel Hacked, Used to Promote Illegal Cryptocurrencies The official YouTube channel of Setopati, a leading Nepali online media outlet, was hacked on January 27 by unidentified attackers. The hackers changed the channel’s name to ‘Ripple’, altered its logo and cover photo, and began promoting illegal cryptocurrencies in Nepal. Setopati, which has over 374,000 subscribers, confirmed the hack through Facebook, alerting readers that irrelevant content was being broadcast. While the channel’s description was removed, other content remains unchanged. | | Digital Rights and Safety School Awareness Campaign Successfully Concludes The Digital Rights and Safety School Awareness Campaign, launched on December 2024, by Digital Rights Advocates Network Gandaki and Eureka, in collaboration with Digital Rights Nepal, has successfully concluded.
